Employment-Based Visa Categories

EB-1: Priority Workers

Reserved for individuals with:

• Extraordinary ability in sciences, arts, education, business, or athletics

• Outstanding professors or researchers

• Multinational managers or executives of international companies

No labor certification required. Fastest processing among all EB categories.

EB-2: Professionals with Advanced Degrees or Exceptional Ability

Eligibility includes:

• Applicants with a Master’s degree or higher

• Individuals with exceptional ability in sciences, arts, or business

• Those seeking a National Interest Waiver (NIW) for work benefiting the U.S.

Labor certification (PERM) generally required unless NIW is granted.

EB-3: Skilled Workers, Professionals, and Other Workers

This category is ideal for:

• Skilled workers with at least 2 years of job experience or training

• Professionals with a U.S. bachelor’s degree or foreign equivalent

• Unskilled workers (other workers) performing labor for which qualified U.S. workers are not available

Requires labor certification and a permanent full-time job offer.

EB-4: Special Immigrants

For specific groups, such as:

• Religious workers

• Certain U.S. government employees abroad

• International organization employees

• Iraqi and Afghan nationals who supported U.S. operations

EB-5: Immigrant Investors

Reserved for individuals investing:

• $1,050,000 in a U.S. business (or $800,000 in a targeted employment area)

• The business must create at least 10 full-time jobs for U.S. workers

Direct path to a Green Card through investment and job creation.

General Application Process

1. Job Offer: (Required for EB-2 and EB-3 unless exempted)

2. PERM Labor Certification: Employer must prove no qualified U.S. workers are available

3. Filing Form I-140: Immigrant Petition for Alien Worker

4. Adjustment of Status or Consular Processing: Green Card application via Form I-485 or visa interview abroad

5. Medical exam & biometric screening
